Terms and conditions, Bansko Chalets EOOD

1.Contract
These terms and conditions cover your contract with Bansko Chalets EOOD. Your contract will exist once you (the client) has completed and returned a booking form and transferred a deposit to Bansko Chalets EOOD. We will issue you with a booking confirmation

2. Reservation

Bansko Chalets EOOD can reserve a holiday for a client for up to 5 days (before payment of the deposit); however, this is not a contractual booking until payment of the deposit and can be cancelled by either the client of Bansko Chalets EOOD at any time.

3. Payment
For advance bookings (i.e. more than 8 weeks prior to the date of arrival) a deposit is payable to Bansko Chalets EOOD. The outstanding balance is due not less than 8 weeks prior to arrival. Bookings made later than 8 weeks prior to arrival require payment of the full sum on confirmation of the booking. Bansko Chalets EOOD requires the appointment of a ‘party leader’ who confirms the holiday booking for all party members and the payment for all members of the party. Should the balance of the holiday not be paid by the due date, Bansko Chalets EOOD reserves the right to retain the deposit and levy cancellation charges where applicable.

4. Website information
Great care and attention is taken in writing the content of our website. However, Bansko Chalets EOOD cannot be held responsible for circumstances outside their control e.g. weather conditions, availability of public services, alterations to the property, etc. nor can they guarantee the working of equipment in the chalet e.g. television, etc. If such changes occur and the company believes that it may be detrimental to the enjoyment of a client’s holiday, we will endeavour to contact the party leader to inform them.

5. Force Majeure
Bansko Chalets EOOD cannot pay compensation, refunds or accept liability for changes or cancellations we are forced to make to your holiday contract resulting from circumstances amounting to Force Majeure. These include, but are not limited to, war, riot, civil action, terrorism, strikes, border closures, natural disasters, pandemics, epidemics, fire, industrial disputes, resort closures, technical problems, inclement weather, natural or nuclear disasters, government action or other events beyond the control of Bansko Chalets EOOD.

6. Covid-19 Pandemic policy

a) (for bookings made for the 2020/21 season where the deposit has been rolled over to 2021/22 season);

If one or more of the following restrictions apply on the day you are due to travel you will receive a credit note for 100% of your balance payment and for 50% of your deposit payment. This credit note will be valid for future bookings with Bansko Chalets EOOD 2 years from the date of issue:

  • UK FCDO (or your departure countries foreign office) advises against all non essential travel to Bulgaria
  • Closure of Bulgarian borders
  • Closure of your departure country borders
  • Your home country requires a mandatory quarantine period on your return. This does not include a quarantine period on return due to a positive Covid test, waiting for a Covid test result or due to you not having a valid vaccination certificate/not being fully vaccinated
  • Your home country introduces local lockdown measures preventing you from leaving your local area
  • Bulgarian National or Local Government introduces obligatory quarantine measures for guests arriving into Bulgaria or Bansko.  This does not include a quarantine period due to a positive Covid test or due to you not having a valid vaccination certificate/not being fully vaccinated
  • Bulgarian National or Local Government has introduced local or general lockdown measures which result in us being unable to operate as a businessIf the Government Restrictions imposed, or the travel advice given by the Bulgarian Government, or your home/return country’s Government, changes part way through your holiday forcing you to cut your holiday short, Bansko Chalets EOOD will not issue a credit voucher or refund for any part of your holiday. You will need to claim this on your travel insurance. If you wish to make a claim on your travel insurance then  Bansko Chalets EOOD   will supply any documentation you need.Concerns about future government restrictions being applied, a disinclination to travel because of Covid-19, or if your travel arrangements ( flight or train ) are cancelled for any reason then  Bansko Chalets EOOD does not accept any liability or responsibility to issue refunds or credit vouchers and will not pay any other compensation.Government Restrictions due to Covid-19 must be in place on the start date of your holiday to be entitled to our refund policy. We reserve the right to ask for official documentation proving restrictions were in place on the start date of your holiday before refunds or credit notes will be processed. Any credit notes or refunds will be issued 30 days after the agreed start date of your holiday.If you or people from your party test positive with a PCR/Antigen test for COVID 19 or have to quarantine due to contact with someone infected then Bansko Chalets EOOD does not accept any liability or responsibility to issue refunds or credit vouchers and will not pay any other compensation. You will need to claim this on your travel insurance. If you wish to make a claim on your travel insurance then  Bansko Chalets EOOD will supply any documentation you need.

    b) for bookings made for the 2021/22 season If one or more of the following restrictions apply on the day you are due to travel you will receive a credit note for 100% of your balance and deposit payment. This credit note will be valid for future bookings with Bansko Chalets EOOD 3 years from the date of issue:

7. Minor alterations made by Bansko Chalets OOD

Bookings made with Bansko Chalets EOOD well in advance of the holiday may be subject to changes. Bansko Chalets EOOD reserves the right to make minor changes to your holiday both before and after your booking has been confirmed. No compensation is payable. Every attempt will be made by Bansko Chalets EOOD to honour the details of your holiday.

8. Alterations made by the client
Alterations made by the client will be subject to availability. Bansko Chalets EOOD will make every attempt to accommodate clients’ wishes; however, should this not be possible the client has the right to cancel their holiday (see clause 9 below).

9.Cancellation

Should you or any member of your party wish to cancel their holiday with Bansko Chalets EOOD, they must do so in writing. At all times your deposit will be retained by Bansko Chalets EOOD to cover administration costs incurred. Cancellation charges are detailed below and are calculated from the date that Bansko Chalets EOOD receives written notification of the cancellation by the party leader. If party members drop out of the group then unless otherwise agreed in writing then the sole occupancy minimum cost of the chalet is based on the original chalet quote (for the whole group) when you made your booking.

10. Cancellation by Bansko Chalets EOOD

Unfortunately we must reserve the right to cancel your holiday with us. If this situation occurs we will either offer you alternative accommodation or a full refund, except where the cancellation is made as a result of circumstances covered in clause 5 and 6.

11. Prices
All prices are quoted in Sterling (payment in Euro is possible, exchange rates will be taken from the Travelex Converter on the internet on the date of payment) . Prices include: VAT, accommodation, food and beverages as stated on the website, all transfers and local taxes. Price does not include: flights, ski school, equipment hire, lift passes, travel to and from your UK airport or insurance.

12. Transfers
Bansko Chalets EOOD offers one private minibus return transfer from Sofia International Airport to the chalet (inclusive in the catered option package).
The earliest the transfer bus can meet you at Sofia airport is 11:30am on your day of arrival.
The transfer bus can leave the chalet between 6:00am and 10am on your day of departure. Please be aware of this when booking your flights.
Bansko Chalets EOOD cannot take liability for any Force Majeure leading to missed flights or appointments. These include technical problems, road traffic delays or accidents or inclement weather

13. Insurance

The Client is required to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, public liability, etc since these are not covered by the Owner’s insurance. On clicking the ‘I have read the Bansko Chalets terms and conditions’ box on completion of the booking form the Client is confirming that a comprehensive travel insurance policy has been arranged to cover the holiday period booked.

14. Non-smoking chalet
Smoking (including pipes and cigars) is not permitted. There is a balcony off the living area in each chalet where smoking is permitted.

15. Client Liability
Clients (and party leaders) are responsible for their behaviour during their stay with Bansko Chalets EOOD. Bansko Chalets EOOD reserve the right to terminate without written notice and liability the holiday arrangements of any client who acts in a manner which is a) harmful to the reputation of the company b) is likely to cause distress, danger or annoyance to other clients, staff or a third party. After which Bansko Chalets EOOD has no further contractual obligations with the client/s involved. The company will be entitled to recover from the clients involved the cost of damages made to property belonging to the company.

16. Breakages and Damage
Clients will be charged for any breakages, losses or damage caused by them.

17. Complaints
Should a problem arise during your holiday please inform a member of Bansko Chalets EOOD as soon as possible and they will make every effort to resolve the issue.

18. Arrivals and departures
Your holiday with Bansko Chalets EOOD commences on collection from the airport on your day of arrival and lasts until 10.00 a.m. on your day of departure. Your chalet will be ready from 4.00 p.m. on your day of arrival. If you arrive earlier a room will be made available for you to change/leave luggage until the chalet is ready. Likewise, on your day of departure, should you wish to ski prior to departure we ask that you vacate the chalet by 10.00 a.m. and a room will be made available for you to change or leave luggage. Bansko Chalets EOOD request that in the event that you depart later in the day out of courtesy to arriving guests, you do not have further access to the rest of the chalet.

19. Children
Bansko Chalets EOOD welcomes children to our chalet; however, we do request that parents provide food for babies (less than 1 year). Bansko Chalets EOOD will provide a cot, high chair, and car seat. Unfortunately, Bansko Chalets EOOD cannot provide childcare but we can recommend childcare facilities in Bansko.

20. Jurisdiction
These terms and conditions and any contract to which they apply are governed in all aspects by EU law and shall be subject to exclusive jurisdiction of the courts of the EU.

21. Personal Liability
Bansko Chalets EOOD accepts no liability for any accident, losses or suffering arising for any reason during a client’s stay. The company will offer assistance wherever possible but such assistance is free and unqualified and carries no liability whatsoever. Clients are strongly advised to check carefully that their insurance provides sufficient personal injury cover.

22. Suppliers
The hire of ski equipment, etc. is a contract between you and that supplier and form no part of your agreement with Bansko Chalets EOOD. Bansko Chalets EOOD cannot accept any responsibility for the supply of these services.

23. Special Requests and Medical Problems

If any client has a medical problem or disability which may affect your holiday this must be disclosed before the booking is confirmed so that we can advise as to the suitability of the chosen arrangements. Any special requests must be advised to us by email at the time of booking.
